Terms of Service

These terms are the agreement between you and AirSpire Health (“AirSpire”, “we”) covering your use of the AirSpire asthma-management service: the patient app, the physician portal, video consultations, prescriptions, and the medication shop. By creating an account you accept them. If you do not accept them, do not use the service.

AirSpire is not for emergencies

If you are struggling to breathe, your rescue inhaler is not helping, or your readings put you in the red zone: use your rescue inhaler and call 112 (or 199) immediately, or go to the nearest emergency room. AirSpire is not monitored around the clock, alerts are not guaranteed to be seen at once, and no message sent through this app will bring emergency help. Never delay emergency care because you are waiting for a reply here.

1. What AirSpire is

AirSpire is a technology platform. It lets you record asthma symptoms and peak-flow readings, calculates a green/yellow/red zone and maintains a written action plan from those readings, books and hosts video consultations with independent physicians, carries the prescriptions those physicians write, and lets you order medication and devices for delivery through pharmacy partners.

AirSpire does not practise medicine. The zone engine is deterministic software that flags risk from the numbers you enter; it does not diagnose you, does not prescribe, and is not a substitute for a clinician’s judgement. Nothing the app generates is medical advice on its own. Your action plan is a tool to use with your physician, and you should follow your physician’s instructions over anything the app displays.

2. Your relationship with your physician

Physicians on AirSpire are independent practitioners, not our employees. We require each one to submit a medical licence and credentials, and we review them before allowing that physician to accept patients, but the clinical relationship, the clinical decisions, and the professional responsibility for your care are between you and your physician. AirSpire is not liable for a physician’s clinical judgement, and we do not overrule it.

Physicians must hold a current licence to practise in Nigeria, keep the credentials on file up to date, treat patient data as confidential, and follow the Health Data Protection Notice. Misrepresenting a credential, or opening the record of a patient you are not treating, ends the account immediately.

3. Eligibility and your account

  • You must be 18 or older to hold an account. A parent or legal guardian may hold and operate an account on behalf of a child under 18.
  • Give accurate information. Clinical software acting on wrong data — a wrong personal-best peak flow, a wrong medication, a missed allergy — produces wrong output.
  • Your account is yours alone. Keep your password private, do not share your login, and tell us at once if you think someone else has used it.
  • One account per person. Do not create an account for someone else without their authority.

4. Acceptable use

You agree not to:

  • Impersonate anyone, or claim a medical qualification you do not hold.
  • Try to reach records, accounts, or endpoints that are not yours, or probe, scan, or attack the service. If you find a security flaw, report it to [email protected] rather than exploiting it.
  • Use the service to obtain prescription-only or controlled medication without a valid prescription, or to resell medication.
  • Upload malware, scrape the service, or use it to send unsolicited messages.
  • Record a video consultation without the other party’s consent.
  • Use the service for anything unlawful under Nigerian law.

5. Fees, payments, and refunds

  • Prices are shown in Nigerian naira (NGN) before you pay. Consultation fees are set by each physician and shown at the time you book.
  • Payments are processed by Paystack. You enter your card or bank details on Paystack’s page, not ours; we receive only a payment reference and status. Paystack’s own terms apply to the payment itself.
  • AirSpire retains a commission from each consultation fee and the treating physician receives the remainder. Payouts run through a Paystack subaccount created for that physician, and physicians can see the current split in their payouts area. The amount you pay is the consultation fee shown before you pay it; the split does not change it.
  • You can cancel a requested or confirmed consultation yourself, from your appointments page, at any time before it takes place. Cancelling releases the slot and marks the appointment cancelled — it does not automatically refund the fee, and there is no fixed cancellation window. If you have paid and believe you are due a refund, contact us and our operations team will review and process it manually.
  • Medication orders: contact us before dispatch to cancel, and our operations team will cancel the order and process any refund manually. Once medication has been dispensed and dispatched, refunds follow the pharmacy partner’s policy and applicable Nigerian consumer law; for safety reasons we cannot accept returns of dispensed medication.
  • If a payment fails, the appointment or order is not confirmed. Never treat an unpaid booking as a confirmed appointment.

6. Prescriptions and medication

A prescription is issued at the sole discretion of the treating physician after a consultation. Paying a consultation fee does not entitle you to a prescription, and asking for a specific medication does not oblige a physician to prescribe it. Prescription-only items in the shop cannot be added to your cart without a valid, current prescription on your record.

Medication is dispensed and delivered by licensed pharmacy partners, not by AirSpire. Check what you receive on arrival and contact us at once if anything is wrong, missing, or appears tampered with. Never take medication that looks wrong.

7. Video consultations

Video visits need a reasonable internet connection and a browser with camera and microphone access. A consultation may not be clinically appropriate for every problem; your physician may end the call and refer you for in-person assessment, which is a clinical decision we do not interfere with. Calls are not recorded by AirSpire.

8. Your data

What we collect and why, who we share it with, how long we keep it, and your rights under the Nigeria Data Protection Act 2023 are set out in the Privacy Policy, and the security measures behind it in the Health Data Protection Notice. Both form part of these terms. You can withdraw consent to health-data collection at any time under Settings → Consent Controls; if you do, AirSpire stops recording new health entries, which means the zone engine and your action plan can no longer be kept current for you.

9. Availability

We aim to keep AirSpire available, but we do not promise uninterrupted service. Planned maintenance, outages at our hosting, payment, or delivery providers, and network problems in between can all interrupt it. Because outages happen, never rely on AirSpire as your only route to urgent care. Keep a written copy of your action plan and your rescue medication to hand.

10. Changes to the service and these terms

We may change, add, or withdraw features. Each version of these terms carries a version label and an effective date; when we change them materially we publish a new version and ask you to review and accept it the next time you open the portal, and your acceptance is recorded against that version. If you do not accept the new version you can close your account and, where you have paid for something you have not received, ask for a refund.

11. Suspension and termination

You can stop using AirSpire whenever you like and ask us to close and erase your account — the erasure section of the Privacy Policy sets out exactly what that removes. We may suspend or close an account that breaches these terms, that we reasonably believe is being used fraudulently or unlawfully, that impersonates a clinician, or that puts other users at risk. Where we can do so safely and lawfully we will tell you why and give you a chance to respond first; where the risk is immediate we may act first. Clinical and financial records we are required to retain survive closure, as described in the Privacy Policy.

12. Disclaimers

Except where Nigerian law does not allow it, AirSpire is provided “as is”. We do not warrant that the service will be uninterrupted or error-free, that its calculations will suit every clinical situation, or that a physician will be available at any particular time. Educational content in the app is general information, not advice about your case.

13. Limitation of liability

To the fullest extent Nigerian law permits, AirSpire is not liable for indirect, incidental, or consequential loss, or for lost profits, revenue, or data, arising from your use of the service. Our total liability to you for any claim connected with the service is limited to the amount you paid us in the 12 months before the claim arose.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under Nigerian law — including liability for death or personal injury caused by negligence, or for fraud. Nothing here limits a physician’s own professional liability to you.

14. Governing law and disputes

These terms are governed by the laws of the Federal Republic of Nigeria, and the courts of Lagos State have jurisdiction over any dispute. Please raise a complaint with us first — most things are resolved that way. Data-protection complaints can go to the Nigeria Data Protection Commission (NDPC), and complaints about a physician’s conduct to the relevant Nigerian medical regulator, in either case without coming to us first.
